We've been trying a new tactic in our battle to potty train Alex. Both kids are highly motivated by money even though they have never really spent any. So when Alex goes to the bathroom both kids get a coin or two. If he goes in his underwear both kids have to give one back.
One day Melly comes up to us with a sad tone in her voice and a nickle and a penny in hand, "Here mom, Alex peed in his pants. It just melts your heart.
A few days later Wendi and I were sitting in the backyard. The kids we playing near by. We were discussing what to plant in place of some unruly trees that we had ripped out. We liked Rose of Sharon bushes but they're not terribly cheap. I calculated that we would need 8 bushes to fill the space. I told Wendi this and she responded, "That's too expensive we'll have to figure something else out."
A minute or two later we hear Melynn raiding her piggy bank. I started to yell at her as she had frequently been getting into it to look at all her money and lose them behind her bed and down the heater vent. She brought us a fist full of coins is spite of my threatening. Placing them in front of Wendi she said, "Here mommy, this is so you can buy your roses."

Day 65 - February 16
Today I launched wave two of my battle:
I
responded to the BBB and I called him on the lies and offered to back
them up with phone records. I concluded my message with the following
paragraph.
It is clear to me that
this company is engaging is deceitful practices and is not willing to
listen to or resolve my concerns. It can be proven through phone
records that at least one of his claims is a lie. Viewed in this light
all of his claims should be considered suspect.
I also sent off a letter to the collection agency disputing the debt.
It was a generic template I pulled off the web full of legal terms.
Finally I sent the company the following email:
How many hours of your employers time will you waste before you realize
that you are fighting a war of attrition? Let's estimate that you make
somewhere around $25.00 an hour. I am asking that you warranty my part
and knock a little over $100 off the bill. That equates to about 4-5
hours of your time. How many hours have you already spent working on
this issue? How many more will you continue to spend responding to BBB
claims, updating your facebook page to push down my comments, writing
reviews of your company to balance out mine. And how many hours will
you spend checking the dozens of sites to see if I've posted a new
review. I'm not on the clock, I'm just an irritated guy trying to get a
fair deal. I've been fairly nice so far, the facebook post was
respectful and I've only reviewed you on one site. I have a whole list
of sites to get to. I noticed the Angieslist badge on your new website,
I'll have to see what I can do about that. Membership is only $15 and
non-members can submit reviews. In addition I haven't brought up the
fact that some of your reviews are obvious fakes. I'm curious though,
are they employees, family/friends, or paid reviewers?
Once I get this issue resolved and behind me I will no longer be irritated and I'll forget all about your company.
So here's what I need:
Submit a warranty claim on my part or not, I don't care. But don't charge me just because you refuse to honor it.
Bill me for the after hours visit, I had forgotten about that in my previous messages and I accept that charge as valid.
Bill
me for an hour of your plumbers time. It is standard practice to round
up to a full hour and I accept that. Standard billing rates for a
plumber are $80-100 per hour. Go ahead and bill me on the high side.
Don't bill me for the returned check fee. If you had dealt with us on
Dec 15th when we called three times we never would have cancelled the
check.
Send me a bill for $135 and I'll pay it immediately and you'll be rid of me.
Otherwise you can count on spending many more hours trying to repair
your online presence, how many will it take - 8, 12, more... all the
while losing customers who check those reviews before selecting a
service company.
A few things you can expect over the next few days:
I caught your
lie in your BBB response. You will shortly receive a rebuttal from
them. It reflects bad on your company when you lie and it's even worse
when it is documented by my phone records.
Your collection agency will inform you that I have disputed the
debt pursuant to Fair Debt Collection Practices Act, 15 USC 1692g
At
random intervals I will post another review on another site. I will
hold off on the first one until at least end of business tomorrow as
today is almost gone. This gives you plenty of time to review your
options and make a decision.
By the way I was heartened last month when I looked you up on
facebook and saw that xxxxxxx xxxxxx (head boss) is a BYU grad. I expected a
reasonable individual who would hear me out, respond to my concerns in a
timely manner and help me resolve this situation. I thought to myself,
"maybe xxxxxxxx has been busy with other things and doesn't even know of
my dispute, maybe he doesn't know that his company is refusing to honor
a manufacturers warranty, or that his employee is being dishonest to
the BBB." I hope that is the case because I had some respect for the xxxxxx name and the university that produced you.
As always please contact me in writing by email or post. I have
been advised not to accept any phone calls from your company at this
time.
Day 66 - February 17
I don't know which part of the email got through to them, I used both the logical approach and the human approach with a few barbs thrown in for good measure, but today I received an email from the secretary with an updated invoice. They accepted all my demands and billed me for exactly the things I asked for.

Day 58 - February 9
Today I decided to go to war and I launched wave one. I posted a message on their facebook wall. The company has since locked down their facebook wall (I'm sure because of me) so only people who like them can see posts. I'm not going to like them so I can't post the text of the message, but it was pretty lightweight. I basically just said that I was a former customer and felt like I was being ignored and asked someone to contact me.
I posted two reviews on google local, I would post the text here but it's no different than what I've said above.
I sent a complaint to the BBB, again I could post the text but it would be redundant.
Day 59 - February 10
Today I received the one and only phone call from the company. I was busy at work and let it go to voice mail. The plumbing manager left a brief message and asked me to call him.
Day 63 - February 14
Today I received a response through the BBB. I have italicized the lines that are not true.
We sent a technician
to the Johansen residence on 12/14/2011. Upon arrival he evaluated their
water heater and wrote up possible options for repair. On the least
expensive option he added a contingency that it would be applied to the
next step if it did not fix the problem. It did not. They declined the
next step. They were charged an after hours dispatch fee and for the
repair that they signed for before the technician started. The price and
procedure were agreed upon before work commenced. We do not charge by
the hour. We are a flat rate company. We don't do any repair without an
authorization by signature first. We do not represent water heater
companies nor have we made a warranty claim on their water heaters. They
put a stop payment on their check. I have talked with Mr. Johansen. I
verified that the technician gave him the price upfront. I stated to him
that we feel that we upheld our end, that the fair price is what was
agreed upon and what he signed for beforehand, and we expect to be paid.
He then threatened to put negative reviews about our company which he
has done. Since then we have made many attempts to contact them for
collection and have left numerous voice mails and have received no
response. He was perfectly aware of what the charges would be and signed
for them, he paid by check, and then put stop payment on that check. So
we have sent him to collections.

Day 27 - January 9
I'm getting tired of putting this off so I decide to send them an email. I know the name of the manager but I can only find a generic "info" email address on their website. I decide to look them up on Facebook, maybe they have better info there. No luck, so I write up an email and send it to the generic address and also send copies of the message to the manager and his boss through Facebook. I have included the message here:
Dear xxxxxx,
I received your notice dated Dec 27 concerning invoice 108904. Thank
you for finally contacting us to resolve this matter. We tried multiple
times to contact you by phone to resolve this matter. At first the
manager we were trying to contact was always unavailable or in a
meeting. When we finally got in contact with him by phone he was
waiting on paperwork from the technician and promised to contact us once
he had the paperwork. We never heard back from him. As it seems phone
communication is not a reliable way of contacting your company we ask
that all further communication be by email or in writing. Also since we
had such trouble expressing our concerns and providing some followup
information we decided to stop payment on the check to make sure that
you would get in touch with us.
Day 36 - January 18
Today we received a letter from a collection agency. It was just a standard form letter. Nothing special to mention. I wasn't very excited about the additional $100 collection fee, but it wasn't unexpected. At this point our bill is a little over $360.

Day 2 - December 15
I called the manufacturer and verified that the warranty was still in effect. I then gave Wendi the job calling the plumber back to figure out what to do about the warranty. She called three times and got the following excuses: "You'll have to talk to the plumbing manager and he's not here.", "He's in a meeting", and upon reaching him, "I don't have the paperwork I'll call you back."
While Wendi was working on this I did a little research of my own. It turns out the the thermocouple is a $12 part. The gas combo valve is about $80. So, quick back of the envelope calculation - 12 dollar part + 30 minutes labor costs $260. How does that sound???
Day 3 - December 16
With no response from the plumbing manager we decided to cancel the check.
Through a friend of my dads we were able to buy a new water heater for under $300 - Thanks Todd!
With my dads help we install the new water heater in about an hour. - Thanks Dad!
Day 14 - December 27
We receive a new invoice from the plumber with a returned check fee added. No mention of the warranty. The manager still hasn't returned our calls.

Preface
This matter is currently resolved so I have not included the name of the plumbing company in this story. If any of you would like to know their name of the company feel free to email me.
This past December I had some big projects at work and I worked some late nights. As December always is things outside of work were also quite busy. In the midst of all this the pilot light on the water heater started going out. I would light it and it would stay on for a day or two. By the second week of December it wouldn't stay lit for 30 minutes. I'm a tinkerer and I like to save money by fixing things myself, but I just hadn't had the time to research this problem. On the 14th Wendi had had enough. We were thee days without hot water and she was tired of my excuses. I was stressed and tired of dealing with it so I agreed to call a plumber.
Day 1 - December 14
The plumber arrived as we were in the middle of making Christmas treats to take to everyone. Wendi was out delivering the first batch so I was juggling a pot of chocolate caramel and the kids. I showed him the water heater and went back to my work. He came back up about a few minutes later and showed me the paperwork with three options. I should have looked at them closer but ya know what they say about hindsight.
The plumber told me that he thought our problem was a bad thermocouple. The price tag for that repair came to $260. I asked what if that isn't the problem. His response, "Oh, that's no problem we'll credit the price towards further repairs." I should have looked at the price of "further repairs" but once again you live and you learn. But in his words, "Don't worry, it's always the thermocouple". I accompanied him downstairs and asked about the warranty. He had said that he thought the water heater was only four years old and that brand usually carries a 6 year warranty. But when I told him we weren't the original purchaser he said he though that the warranty didn't transfer. I went back to my business and twenty minutes later he came back up with bad news, it wasn't the thermocouple. At this point he explained options 2 and 3. He could replace the gas combo valve for $480 or he could replace the whole water heater for $1600. I may not know the price of a thermocouple or a gas combo valve but I know it shouldn't cost $1600 for a new water heater. At this point I declined further service. I asked if he could pull the part and just bill me for his time. He said that his suppliers wouldn't take a part back once it had been installed. So, frustrated, I sent him with a check for $260 and I was no better off than before he showed up.
Later that evening I starting doing some research online. I found that the manufacturer does transfer the warranty to new home owners. In fact the manufacturer has a spot where I could plug in my serial and check if my warranty was still good. Turns out it was still under warranty. Although I was upset over paying $260 with no resolution I was heartened that maybe I could recoup a little money.

Peter's priesthood class got out late today and I was home sick. Melynn's primary teacher took her to look for him and asked her what her dad looked like and Melly's response was "he has brown eyes and a cute face". How cute is my little girl. Melts your heart!
